JUSTICE SUDHIR SINGH ORAL ORDER 07-09-2016 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners were granted bail vide Cr. Misc. No. 13486 of 2014 dated 16.06.2014 along with other accused persons but due to inadvertent mistake regarding the antecedent of the petitioners, incorrect statement was made, for which, the bail of the petitioners was cancelled vide Cr. Misc. No. 32449 of 2014 dated 21.08.2015 and in pursuance of the said order (Annexure3), the petitioners were taken into custody since 19.10.2015 and 09.11.2015 respectively. The petitioners have sufficiently been punished for making incorrect statement in para-3 of their application. They have remained in custody for more than 10 months.

Patna High Court Cr.Misc. No.29933 of 2016 (3) dt.07-09-2016 2/2 On behalf of the state, it has been submitted that the petitioner is named in the First Information Report. Considering the aforesaid facts and circumstances and period of custody, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Gaya, in connection with S. Trial No. 61 of 2016, arising out of Paraiya P.S. Case No. 117 of 2013.
