JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Turkaulia P.S. Case No.569/16 registered under Sections 272, 273 of the Indian Penal Code 30(A) of the Bihar Prohibition & Excise Act.

The accusation is of recovery of semi prepared material for preparing liquor contained in four containers, four liters liquor in two bottles and other materials for preparing liquor near the drain situated behind the house of the petitioner from where petitioner was seen fleeing away.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.12809 of 2017 (2) dt.18-04-2017 petitioner has been falsely implicated in this case on mere suspicion. He has no criminal antecedent Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event ofhis arrest or surrender before the learned Court below within a period of weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari Champaran, in connection with Turkaulia P.S.Case No.569/16, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
