JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-04-2022 Heard learned counsel for the petitioner and the State. Prayer for bail of this petitioner was earlier rejected by this court vide order dated 06.03.2020 passed in Cr. Misc. No. 71915/2019 with a direction to the trial court to conclude the trial within one year.

It is submitted that even after lapse of more than one year the trial has not yet concluded. The trial court report reveals that out of eight charge sheet witnesses seven have been examined and only I.O. has remained to be examined. Learned counsel appearing for the State opposes the prayer for bail.

Considering the nature of accusation, gravity of the offence and progress of the trial, I am not inclined to enlarge the

Patna High Court CR. MISC. No.67938 of 2021(3) dt.21-04-2022 2/2 petitioner on bail. Accordingly, the same is rejected. However, since the petitioner is in custody since 26.04.2019, the trial court is directed to conclude the trial as early as possible, preferably, within six months from the date of receipt/ production of a copy of this order.
