JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-09-2018 From the order dated 12.4.2016, it appears that this case was adjourned for listing after disposal of LPA No. 218 of 2016 as the decision of the LPA Court has a bearing on the issue raised in the present writ application.

The LPA No. 218 of 2016 preferred by the State of Bihar was dismissed by the Division Bench vide order dated 25.07.2016 and the decision of the writ court in C.W.J.C. No. 21232 of 2014 was affirmed.

In view of the decision of the LPA Court in LPA No. 218 of 2016, the present writ application is also allowed in terms of the decision of the writ court in C.W.J.C. No. 21232 of

Patna High Court CWJC No.5483 of 2014(4) dt.05-09-2018 2/22014 2014 and the respondents are hereby directed to to work out the entitlement of the petitioner in terms of the decision of the coordinate bench of this court in C.W.J.C. No. 21232 of 2014 dated 23.06.2015 approved by LPA Court in LPA No. 218 of 2016 vide judgment dated 25.7.2016.

The entire exercise with regard to payment of consequential benefit must be completed by the respondents within a period of four months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
