JUSTICE ARUN KUMAR ORAL ORDER 10-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 14.11.2017, seeks bail in Gandhi Maidan PS Case No. 515 of 2017 registered under Sections 467, 468, 471, 409, 420, 120B & 34of the IPC and Section 13(i)(c)(d) & 13(2) of P.C.Act.
Accusation against this petitioner is that five lakh rupees was deposited in his personal account by Biteshwar Prasad Singh, Accountant, one of the key accused and later on said amount was transferred to the account of mother of the petitioner who happens to be Treasurer of Maa Sarveshwari Seva Sansthan NGO. Learned Counsel for the petitioner submits that there was some transaction made to the Maa Sarveshwari Seva Sansthan and the said NGO and the principal accused persons have been in connivance but the petitioner is not concerned with the NGO and only five lakh rupees was transferred by accused Biteshwar Prasad Singh for giving it to his mother who runs NGO but petitioner had no concern or knowledge about the nature of transaction. Further learned Counsel submits that Rupees. 2,97,000/- was also transferred
Patna High Court Cr.Misc. No.23604 of 2018 (6) dt.10-08-2018 by Biteshwar Prasad Singh in the personal account of Priti Bharti, another co-accused, member of the NGO and she was admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 14985 of 2018.
Having considered the aforesaid facts and circumstances, as the petitioner has no concern with the NGO Maa Sarveshwari Seva Sansthan rather his mother and sister are office bearers and the money was transferred to his mother's account finally, so the petitioner, namely, Surakshit Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Vigilance lst, Patna in connection with Gandhi Maidan PS Case No. 515 of 2017.
