The petitioner apprehends his arrest in a case registered for the offence punishable u/s 420, 406/34 of the IPC. 3.

As per FIR, the petitioner along with other co-accused persons are said to have embezzled Rs.6,78,943/- of the loan holders of the company.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. It is submitted that petitioner is ready to deposit Rs.2,38,058/- within eight months. It is further submitted that the petitioner has no criminal antecedent as mentioned in para 3 of the bail application.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case and since petitioner is agreed to return the aforesaid amount, let the above named petitioner, be released on provisional bail for a period of ten months, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Sheohar P.S. Case No.178 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The learned court below is directed to confirm the provisional bail of the petitioner after satisfying that the petitioner has paid the aforesaid amount.
