The petitioner is accused in connection with Jagdishpur P.S. Case No. 159 of 2014 registered under sections 304B/201/120B/34 of the I.P.C. pending in the Court of Judicial Magistrate, First Class, Ara, Bhojpur.

The accusation is about torturing the sister of the informant, Babita Devi for non-fulfillment of demand of dowry by her husband-petitioner and in-laws and thereafter, burnt her to death.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case and is in custody since 23.09.2014.

Admittedly, the deceased Babita Devi, sister of the informant died at her Sasural within two years of her marriage and

Patna High Court Cr.Misc. No.19305 of 2015 (3) dt.09-09-2015 2/2 her dead body was recovered from funeral place in burning condition.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Rajendra Kumar Mishra, J.) Shail/- U T
