====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 447, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case is that on the order of co-accused Gyanveer Singh, co-accused Mahapurush Singh fired on the informant which did not cause any injury. The petitioner is not named in the FIR but his name subsequently sprang up after two years of the registration of the case as the accused persons who resorted to fire were moving on the motorcycle of the petitioner on the alleged date of occurrence.
It is submitted by learned counsel for the petitioner that the petitioner is the agnate of the informant and due to land
Patna High Court Cr.Misc. No.24164 of 2016 (2) dt.31-05-2016 2/2 dispute, the accusation has been levelled. There is counter version of the occurrence also. The petitioner was not named in the FIR and suspicion has been raised against the petitioner after two years of the occurrence. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bihar Sharif, Nalanda in connection with Harnaut P.S. Case No.
120 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bonds of the petitioner shall be accepted by the learned court below on filing affidavit that he will regularly cooperate during investigation. Non-cooperation of the petitioner during investigation will give liberty to the learned court below to cancel the bail bonds of the petitioner.
