JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 The petitioner seeks regular bail in connection with K. Hat (Maranga) P.S. Case No. 773 of 2015, registered for offences punishable under Section 302 of the Indian Penal Code. As per F.I.R., allegation is that petitioner informed the wife of deceased about the death of the deceased, thereafter, she came and lodged the case, in which she suspected the hands of one Rikky Singh and Mritunjay Singh, who alleged to have conspired in the murder of hr husband with the help of others. It appears that petitioner is not named in the F.I.R, his name has come during course of investigation. It has been submitted on behalf of the petitioner that he is not named in the F.I.R. and has falsely been made accused

Patna High Court Cr.Misc. No.52283 of 2018(3) dt.05-11-2018 2/2 in this case and except suspicion that the petitioner was not happy with the money transaction with the uncle, there is nothing against the petitioner and he has no criminal antecedent and has been in judicial custody since 25.06.2018. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Hat (Maranga) P.S. Case No. 773 of 2015, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
