Petitioners are in custody in connection with Gogri P.S. Case No. 131 of 2019 for the offence under section 25(1AA)/26/35 of the Arms Act. Learned counsel for the petitioners submits no case is made out against the petitioners under Arms Act. He further submits that in the instant case half manufactured arm was recovered from the house of the petitioners.

The petitioners are in custody since 28.4.2019. Considering the fact that petitioners have remained in custody for nearly nine months, the Curt is inclined to grant bail

Patna High Court CR. MISC. No.59483 of 2019(4) dt.03-02-2020 2/2 to the petitioners, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Khagaria, in connection with Gogri P.S. Case No. 131 of 2019.

The court below is directed to expedite the trial and conclude the same at the earliest, preferably within a period of three months from the date of receipt/production of a copy of this order.

In the event, the petitioners adopt dilly-dally in conclusion of the trial, the court below shall be at liberty to cancel the bail bonds of the petitioners.
