The petitioner seeks bail in a case registered under Sections 341, 323, 307, 429 and 302/34 of the Indian Penal Code.
Allegation is that the accused persons including the petitioner assaulted the informant's father, namely, Bachan Tanti by means of lathi and khanti, due to which he sustained injuries on his head. The informant's father was taken to the Hospital for treatment and in course of treatment he died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.04.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged
Patna High Court CR. MISC. No.53339 of 2019(2) dt.26-08-2019 2/2 against the petitioner. The F.I.R. was instituted for an offence under Section 307 of I.P.C. Later on, after death of the victim Section 302 of I.P.C. has been added in the present case. General and omnibus allegation has been made. No specific overt act is alleged against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Jamui (Adarsh) P.S. case No.190 of 2019.
