ANJANA PRAKASH ORAL ORDER 06-04-2015 This is an application for quashing of complaint bearing No. G.O. Case No. 28 of 2000, under Section 29 of the Industrial Dispute Act, 1947, pending before the C.J.M. Samastipur. The case of the complainant is that the dispute in Award in favour of 33 workmen of Central Industrial Tribunal, Dhanbad, dated 21.01.1991, the Management of Central Tobacco Research Institute had failed to implement the same. A certificate case was also filed in this regard and the present complaint was filed for implementation of the Award.

From perusal of the petition, I find that the opposite party no. 2 had filed Certificate Case bearing No. 12 of 1998-99 but plea was dismissed vide order dated 15.01.2001. Thereafter,

Patna High Court Cr.Misc. No.30014 of 2012 (7) dt.06-04-2015 2 / 2 contempt petition was filed before this Court which was also dismissed on 03.02.2004 for non-prosecution.

Since the certificate case regarding the amount has come to an end, there is no reason for continuance of the present complaint on the same set of facts.

Hence, the application stands allowed and the complaint bearing No. G.O. Case No. 28 of 2000, pending before the C.J.M., Samastipur, is quashed.
