The petitioner, who is in custody, seeks bail in connection with Chandan (Anandpur) P.S. Case No. 33 of 2018 registered for the offences punishable under Section 302 of the Indian Penal Code.

Informant who is the father of deceased has alleged that petitioner (devar) has killed his daughter by pressing her neck, due to family dispute. The cause of death in Post Mortem report is strangulation.

It has been submitted on behalf of petitioner that

Patna High Court Cr.Misc. No.52091 of 2018(3) dt.01-11-2018 2/2 he is innocent and has falsely been implicated in this case. He is separate from family of his brother and deceased and allegation of torture and killing is false.

Considering the direct allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected at this stage.

However, petitioner may renew his prayer for bail after one year of custody.
