The petitioner, who is in custody, seeks bail in connection with Pirpainti P.S. Case No. 94 of 2013 registered for the offence punishable under Sections 147, 148, 448, 323, 307, 504, 379 of the Indian Penal Code and later on Section 302 was added.

Informant is the father of victim, who in his written report has stated that on 07.07.2013 seven persons including petitioner entered in his house and assaulted his daughter namely Anma Kumari and took away golden chain, due to which she got head injury and in course of treatment after few days she died.

There is general and omnibus allegations against the petitioner. It has been further submitted that similarly situated persons have granted bail by a different Co-ordinate Bench of this Court as contained in Annexure-2 series. It has further been submitted that petitioner has no criminal antecedent and is in custody since 19.12.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XI, Bhagalpur, in connection with Pirpainti P.S. Case No. 94 of 2013.
