The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467,468,471 and 409 of the Indian Penal Code. It is alleged by the informant being the Junior Engineer that the petitioner being Program Officer under MANREGA scheme misappropriated Rupees Twenty Five Lacs of Scheme Nos. 1/09-10, 2/09-10, 06/09-10, 12/10-11, 26/10-11 and 27/10-11 as the amount was withdrawn
Patna High Court Cr.Misc. No.19320 of 2015 (2) dt.30-04-2015 2/3 without taking technical sanction and verification of muster roll.
It is submitted by the learned counsel for the petitioner that for the misappropriation of money in the aforesaid six schemes, enquiry was conducted and the petitioner was party to the enquiry team and subsequently, the petitioner lodged Balia P.S. Case No. 20 of 2012 on 7.2.2012 with regard to misappropriation of money in the aforesaid six schemes. The informant was accused in the said case and was taken into custody. It is further submitted that for the schemes being executed in 2009-10 and 2010-11 the complaint was filed on 13.8.2014 which came to be registered as police case on 15.10.2014.
Considering the fact that for the same misappropriation, the case was lodged by the petitioner at earlier point of time, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in
