====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 13-08-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Jandaha P.S. Case No. 69 of 2016 registered for the offences punishable under Sections 376/511 of Indian Penal Code and Section 4/8 of POCSO Act.

Informant is the mother of the victim, who in her written complaint has stated that on 23.05.2016 at about 12 O'clock his daughter Mushkan Khatoon, aged about 9 years was playing in the front of the house and thereafter she heard crying of her daughter and when she went there she found petitioner was trying to commit rape upon her.

It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent and he is in custody

Patna High Court Cr.Misc. No.24441 of 2018(6) dt.13-08-2018 2/2 since 24.05.2016. It is further submitted that report was called for from the trial court and report has come, in which it has been stated that case is pending for evidence and summons and warrants have been issued for the witnesses for their appearance but none has turned up.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge 1st cum-Special-Judge, Vaishali at Hajipur, in connection with Jandaha P.S.
