JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dalsinghsarai P.S. Case No. 82 of 2013 registered for the offences punishable under Sections 363, 366A/34, 376 G of the Indian Penal Code and Section 7 of POCSO Act.

Taking into consideration that victim, who happens to be minor, has very clearly stated about the involvement of the petitioner in the alleged crime leveling allegation of kidnapping and rape, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Dalsinghsarai P.S. Case No. 82 of 2013

Patna High Court Cr.Misc. No.22074 of 2015 (2) dt.09-07-2015 pending in the court of Additional Chief Judicial Magistrate, Samastipur stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
