JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-03-2024 The present writ petition has been filed seeking the following reliefs:- "i) To issue an appropriate order/s, direction/s including a writ preferably in the Nature of Certiorari for quashing the order dated 26.7.2022 passed by the Collector, Gopalganj in Anganwari Appeal Case No.02 of 2022, whereby and whereunder he has allowed the appeal in favour the private respondent and set aside the order

Patna High Court CWJC No.15250 of 2022(2) dt.12-03-2024 2/3 10.02.2022 passed in Anganbari Appeal Case No.134 of 2022 passed by the District Pragrame Officer, Gopalganj and affirmed the order of Child Development Project Officer, Bhore who has issued appointment letter to the private Respondent for the post of Anganwari Sevika for Angangwari Centre No.210 Ward No.04, Chakrwan Panchayat Under Bhore Block, District Gopalganj.

ii) To quash the Selection letter / Appointment letter dated 13.08.2018 issued to the Sole private Respondent, who has been appointed to the post of Anganwari Sevika for the said Panchayat and Anganwari Centre, situated in Bhore Block of District Gopalganj issued under the seal and signature of the Respondent No.7.

iii) To direct the respondent No.07 to appoint the petitioner to the post of question for the Anganwadi Centre No.210 situated in Ward No.04 of the Ctakrawasn Panchayat under Bhore Block of Gopalganj District."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including

Patna High Court CWJC No.15250 of 2022(2) dt.12-03-2024 3/3 that of filing a civil suit before the learned civil court of competent jurisdiction. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
