JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks regular bail in connection with Phulwariya P.S. Case No. 99/1999, registered for offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

Allegation as per F.I.R. is that the petitioner called the brother of the informant, thereafter, the dead body of the brother of the informant was found.

It has been submitted on behalf of the petitioner that she is not named in the F.I.R. and has been made accused in this case only later on she was made accused in this case only on the basis of suspicion and except that there is nothing against her. Further submission is that as she had no knowledge, she could not surrender in the court in time and now she has been in judicial custody since 12.04.2018.

Patna High Court Cr.Misc. No.57976 of 2018(4) dt.20-12-2018 2/2 Learned counsel for the State opposed the prayer for bail and submitted that she has not been named in the F.I.R by name but she has been shown as wife of co-accused Arjun Jha.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -Ist Class, Begusarai, in connection with Phulwariya P.S. Case No. 99/1999, subject to the condition that petitioner will cooperate in disposal of trial and make herself available as and when required by the court below, failing which, the prosecution shall move for cancellation of her bail bonds.
