2. The petitioner seeks bail in connection with Bettiah Muffasil PS Case No.139 of 2025 dated 08.03.2025, instituted for the offence punishable under Sections 126(2), 115(2), 118(1), 109(1), 352, 303(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he assaulted the informant on his head by means of Khanti due to which he sustained head injury

4. Learned counsel for the petitioner submits that both parties are neighbours. The occurrence took place on account of petty dispute of drainage. Hot exchange took place between the parties which resulted in the occurrence. Learned counsel

No.55737 of 2025(2) dt.12-08-2025 2/2 further submits that the injury report of the informant will show that the doctor has found simple injury on the person of the injured caused by hard and blunt object. Lastly, it is submitted that the petitioner is in custody since 30.05.2025 having clean antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in Bettiah Muffasil PS Case No.139 of 2025.

7. The application stands allowed.
