JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. Petitioner was caught on the spot when he along with others, allegedly, assembled to make preparation for committing dacoity. One country made loaded katta was recovered from conscious possession of the petitioner whereas motorcycles and another katta are said to have been recovered from possession of other accused persons. Petitioner does not have any criminal antecedent and is languishing in jail custody since 16.02.2016. Submission on behalf of the petitioner is that

No.26022 of 2016 (3) dt.04-07-2016 2/2 petitioner is a student and as a matter of fact, nothing had been recovered from conscious possession of the petitioner and the police manufactured the present case against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh P.S.
