2. Learned Counsel for the petitioner submits that the present Miscellaneous Jurisdiction Case No.2783 of 2024 has been filed for restoration of Civil Writ Jurisdiction Case No. 3134 of 2020 to its original file which was dismissed due to non prosecution on 21.12.2023.

3. Learned Counsel for the State submits that CWJC No.3134 of 2020 was dismissed due to non prosecution on 21.12.2023 due to the reason that on earlier occasion also vide

Patna High Court MJC No.2783 of 2024(3) dt.04-04-2025 2/2 order dated 07.12.2023, no one appeared on behalf of the petitioner and as a matter of last indulgence, matter was adjourned with specific direction that if, on the next date of hearing, none appears on behalf of the petitioner, then the Court will constrain to pass appropriate order. And thereafter, on 21.12.2023, no one appeared on behalf of the petitioner, therefore, the case was dismissed due to non prosecution.

4. In response thereof, Counsel for the petitioner submits that such mistake shall not take place in future and he is ready to deposit a cost of Rs.500/- (Rupees Five Hundred) in the Patna High Court Legal Services Committee.

5. In this view of the matter, the present Miscellaneous Jurisdiction Case No.2783 of 2024 is hereby allowed and let, Civil Writ Jurisdiction Case No.3134 of 2020 be restored to its original file subject to payment of Rs.500/- (Rupees Five Hundred) by Counsel for the petitioner payable to Patna High Court Legal Services Committee.
