JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 385, 420 of the Indian Penal Code and Section 7(a) (b) of Prevention of Corruption Act, 1988.
Petitioner was caught in camera while taking bribe of rupees fifteen thousand.
Submission on behalf of the petitioner is that even if the above stated accusation assumed to be true, then also, it is only seen in video that petitioner was counting cash and moreover, petitioner is in jail custody since 15.06.2019 and the
Patna High Court CR. MISC. No.55064 of 2019(3) dt.27-11-2019 2/2 investigation against him has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind that charge sheet against the petitioner has already been submitted, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Vigilance) North Bihar, Muzaffarpur in connection with Hathauri P.S.
