The petitioner seeks bail in a case registered under Section 366(A) and other sections of the Indian Penal Code. The informant made allegation that the petitioner kidnapped his miner daughter but the victim appeared and made her statement under Section 164 of the Code of Criminal Procedure and she disclosed that out of her freewill, she left her house and went along with the petitioner to different places. She also solemnized marriage.
Learned counsel for the informant submits that the victim is a minor girl. According to the date of birth mentioned in the School Leaving Certificate, she is aged about 16 years. The petitioner enticed the victim.
On a consideration of the facts that the victim herself
Patna High Court Cr.Misc. No.19568 of 2015 (3) dt.25-06-2015 2/2 disclosed that she left her house out of her freewill and went along with the petitioner to different places and the petitioner did not do any illegal act with her, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in Supaul P.S. Case No. 88 of 2015.
