It would appear from perusal of para 71 of the case diary that one person was arrested and the informant identified that person in police station and thereafter on his disclosure petitioner and another accused were arrested and the petitioner confessed his guilt but it is spurring enough that the petitioner was not put on test identification parade, particularly, in the circumstance, when two other accused were put on test identification parade by the Investigating officer. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Jehanabad P.S.
