The petitioner apprehends his arrest in connection with Piro P. S. Case No. 240 of 2016 instituted under Sections 379/34 of the Indian Penal Code.

The allegation, in brief, is that this petitioner has committed theft of two she-buffaloes of the informant. Submission is that merely on the basis of suspicion this petitioner has been made accused in this case and except disclosure of the name by co-accused Asghar Kasai, there is no other material against him and the petitioner has only one criminal antecedent of similar nature and in that case too he was granted anticipatory bail by this Hon'ble Court by order dated 30.11.2016 in Cr. Misc. No. 43512 of 2016.

No.6506 of 2017 (3) dt.18-03-2017 2/2 Having considered the aforesaid facts and circumstances, let the petitioner, namely, Sunil Kasai @ Sunil Kureshi, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Bhojpur, Ara in connection with Piro P.S.Case No. 240 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
