The petitioner apprehends his arrest in Malsalami P.S. case no. 11 of 2017 instituted for the offence under Sections 272, 273 of Indian Penal Code and Section 30 of Bihar Prohibition and Excise Act, 2016.
It is submitted on behalf of petitioner that he has clean antecedent and his name has been taken by Sandeep Kumar and Vickky Kumar who have been apprehended by the police at the spot.
From written report, it appears that on receiving information that some people are selling illegal wine, police came to the place of occurrence and apprehended two persons Sandeep
Patna High Court Cr.Misc. No.11753 of 2017 (2) dt.22-03-2017 2/2 and Vickky and recovered illicit liquors from their possession as mentioned in written report. These persons disclosed the name of this petitioner as supplier of the wine to them. It is mentioned in para 3 that petitioner has clean antecedent. He was never involved in sale and purchase of wine.
Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Malsalami P.S. case no. 11 of 2017, he shall be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K. Bharti, learned Judicial Magistrate, Patna City Patna subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure. (Sanjay Priya, J.) rinkee/- U T
