The petitioner apprehends his arrest in connection with Nabinagar P.S. Case No.40 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The name of the petitioner surfaced in this case only on the basis of confessional statement of co-accused Bhim Yadav. It is further submitted that the petitioner has got no concern with the alleged illicit liquor or seized motorcycle. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances

Patna High Court CR. MISC. No.63295 of 2022(4) dt.07-02-2023 2/2 of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Special Judge, Excise Court No.1, Aurangabad in connection with Nabinagar P.S. Case No.40 of 2021 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
