====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 18-08-2025 Heard Mr. Danish Sami, learned counsel for the petitioners and Mr. Uday Pratap Singh, learned APP for the State.
2. Petitioners seek regular bail in connection with Jokihat P.S. Case No. 182 of 2025 dated 09.06.2025 registered for the offences punishable under sections 126(2), 115(2), 118(1), 76, 303(2), 352 and 351(3) read with section 3(5) of the Bharatiya Nyaya Sanhita (in short 'BNS') and later, section 103(2) of BNS was added.
3. The main submissions advanced by petitioners' counsel are that the petitioner No. 1 is a 24 year old lady while the petitioner No. 2 is a 18 year old young girl and the FIR has been registered against twelve persons including the petitioners,

Jamal but both the petitioners have not been alleged to have inflicted any blow on the body of the deceased and the main allegation as to assaulting Md. Jamal (deceased) is against coaccused persons and the petitioners have been made accused on account of being the family members of the co-accused. It is further submitted that both the petitioners have been languishing in jail since 13.06.2025, having fair and clean antecedent.
4. Learned APP for the State has opposed the prayer of the petitioner.

Considering the aforesaid submissions and mainly the petitioners' role in the commission of the alleged occurrence and also the fact that both the petitioners are young ladies, in my opinion, it is a fit case for bail to the petitioners. Accordingly, let the petitioners named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the court concerned in connection with Jokihat P.S. Case No. 182 of 2025.
