Petitioner seeks bail in Special Case 22/18 arising out of Kadamkuan P.S.Case No.168 of 2018 registered for the offences under Sections 20, 22 of the N.D.P.S.Act.

Allegation against the petitioner is of recovery of 1 kg. 900 grams ganja from tea stall.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and moreover he is in custody for about six months and recovery is much less than the commercial quantity. Though he is accused in two more cases but not in similar type of cases.

Having heard both sides and in view of the facts and

No.46867 of 2018 (3) dt.19-09-2018 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Sessions Judge/Special Judge, Patna, in Special Case No.22/18 arising out of Kadamkuan P.S. Case No.168 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
