Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/201/34 of the Indian Penal Code.

The FIR was registered against unknown for the murder of son of the informant.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation only on suspicion on the ground that petitioner had illicit relation with the wife of deceased and also he had taken some loan from him and in order to marry the wife of deceased and to get rid of the loan petitioner is alleged to have hired contract killers and committed the murder of the deceased. Patna High Court CR. MISC. No.67428 of 2021(4) dt.25-04-2022 2/2 in custody since 14.04.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that on the disclosure made by this petitioner mobile of the deceased and weapon used in the crime were recovered from the house of this petitioner. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
