The petitioner apprehends his arrest in connection with Bidupur P.S. Case no. 284 of 2016, registered under Sections 147, 341, 323, 324, 307, 379, 354, 504 and 506 of the Indian Penal Code. The accusation is that five persons named in the F.I.R., including the petitioner, reached at the door of the informant and started pelting brick and stone at the informant and made complaint why she has constructed wall. On protest, all the accused started to cause assault through fists and slaps to the informant. At that time, this petitioner caused injury at her head through farsa in which she sustained blood oozing injury and fell down on the ground then all the accused snatched her golden chain worth of Rs. 45,000/-. Learned counsel for the petitioner submits that while there is specific allegation has been made against the petitioner at the
Patna High Court Cr.Misc. No.13389 of 2017 (2) dt.01-05-2017 2/2 head of the informant, but only one cut injury found on the partial region, which was simple in nature.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 284 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
