The petitioner apprehends his arrest in Tajpur P.S. Case No. 252 of 2016 instituted for the offence under Sections 272 and 273 of the Indian Penal Code, Section 47(A) of Excise Act and Sections 54 and 57 of New Bihar Excise (Amendment) Act, 2016.

From the written report, it appears that one Surendra Das was apprehended by the police and foreign liquor has been recovered from his house. The informant has further stated that this petitioner and other two persons managed to run away. From the seizure list, it appears that foreign liquor has been recovered from the house of Surendra Das. It is

Patna High Court Cr.Misc. No.6157 of 2017 (2) dt.17-02-2017 2/2 mentioned in para-3 of bail petition that petitioner has clean antecedent. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.

In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Tajpur P.S. Case No. 252 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, subject to the conditions as laid down under Section 438(2) Cr.P.C.
