The petitioner seeks bail in Khagaul P.S. Case No. 70 of 2019, instituted for the offence under Section(s) 302/34 of Indian Penal Code and Section 27 of the Arms Act. It is alleged in the written report that son of the informant was found dead near Khagaul Jora Pond having sustained injury by firearms. It is further alleged in the written report that on 14.3.2019 petitioner and co-accused Golu Kuumar had given threat of dire-consequences to son of the informant. Counsel for the petitioner submits that name of this petitioner has come in the written report merely on suspicion. The informant is not eye witness of the occurrence. He further

Patna High Court CR. MISC. No.53102 of 2019(2) dt.28-08-2019 2/2 submits that besides such allegation in the written report, there is no allegation of overt act against the petitioner. Petitioner is in custody since 28.4.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Danapur, in connection with Khagaul P.S. Case No. 70 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
