JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Bagaha P.S. Case No. 475 of 2016 instituted for the offence under Sections 420, 409, 467, 468 and 471 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is working since 1988. In the year 2016 without holding any enquiry, First Information Report has been lodged against the petitioner alleging that his appointment letter dated 18.12.1988 was forged. It has further been submitted that the petitioner is still working and no departmental proceeding has ever been initiated against him.

From the written report it appears that on the basis of

Patna High Court Cr.Misc. No.14440 of 2017 (2) dt.29-03-2017 2/2 report obtained from Civil Surgeon,Vaishali dated 2.12.2016, the First Information Report was lodged against the petitioner. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Bagaha P.S. Case No. 475 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha (West Champaran), subject to the conditions as laid down under Section 438 (2) Cr.
