The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342, 363, 323, 504, 506/34 of the Indian Penal Code and 3(1)(x) (xi) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that the petitioners made unsuccessful attempt to abduct the minor daughter of the informant and abused the informant and his family members by calling caste name.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.23792 of 2016 (2) dt.26-05-2016 2/2 petitioners that the petitioners are neighbour of the informant and for a petty dispute the accusation has been levelled. It is further submitted that even assuming the accusation no offence under Section 363 IPC is made out.
Considering the nature of accusation, it is a case for consideration of prayer for regular bail by the learned court below, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Govindganj P.S. Case No. 390 of 2015 pending in the court of learned Sub-divisional Judicial Magistrate, Sadar, Motihari, East Champaran.
With the aforesaid observation, this application is disposed of.
