08-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking anticipatory bail in connection with Beldour P.S. Case No. 03/2017, G.R. No. 32/2017 registered under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

Perused the case diary. It appears that after investigation police found the case true against one Anil Kumar Singh. Learned counsel for the petitioner submits that so far as this petitioner is concerned, he has been falsely implicated because of a land dispute. The petitioner seems to be the nephew of the informant. Even though the police did not find any material to proceed against him, differing with the police report cognizance has been taken by the learned

Learned counsel submits that the petitioner has no criminal antecedent and the sole reason of his implication is the land dispute.

In the given facts and circumstances, taking into consideration the submissions of the learned counsel for the petitioner that the dispute between the petitioner and his uncle has led to institution of the present case and the police had not found any sufficient material to proceed against him, in the event of his arrest/surrender before the court below within four weeks, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - III, Khagaria, in connection with Beldour P.S. Case No. 03/2017, G.R. No. 32/2017, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
