The petitioner is languishing in custody since 24.01.2016 in connection with Shakurabad P.S. Case No. 71 of 2014 registered for offences under Sections 341,323,307 and 448/34 of the Indian Penal Code and 27 of the Arms Act. The prosecution story, in brief, is that on 6.7.2014 the accused persons came and surrounded the informant. The accused Rajesh Sharma @Puki has fired by pistol as a result of which informant has sustained fire arm injury at right palm. The rest accused persons have also fired by their pistol as a result, the informant got injury on different parts of body and became unconscious and fell down.
On behalf of the petitioner, it is submitted that the
Patna High Court Cr.Misc. No.29191 of 2016 (3) dt.01-09-2016 petitioner is in custody since 24.01.2016. Charge-sheet has been submitted in the present case. The petitioner has got no criminal antecedent. General and omnibus allegation has been made against the petitioner. No specific allegation has been attributed against the petitioner. It is further submitted that the petitioner may be released after completion of one year in custody from 24.01.2016 On behalf of the State, petitioner has named in the FIR and is alleged to have fired upon the victim along with other coaccused. There are as many as four fire arm injuries on the body of the deceased.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of one year in custody from 24.01.2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Shakurabad P.S. Case No. 71 of 2014.
