====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 18-02-2022 Heard learned counsel for the petitioner and Mr. Binor Kumar, learned A.P.P. for the State through virtual court proceedings.

The petitioner seeks bail in connection with Mahua P.S. Case No. 568 of 2021 instituted for the offences under Sections 30(a), 32(i), 32(ii), 41(i), 41(ii), 36 of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.09.2021, charge-sheet has been submitted in the case and has antecedents of two cases. Learned counsel for the petitioner submits that allegation is of recovery of 1883.520 liters foreign liquor from a truck as detailed in the F.I.R.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.67500 of 2021(2) dt.18-02-2022 2/2 petitioner is not the owner, nor the driver of the truck and he had merely taken lift and came to be implicated when the search was made.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 10.09.2021, charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2o,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Mahua P.s. Case No. 568 of 2021.
