The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341/323/379/307/504/34 of the Indian Penal Code. For land dispute the petitioners, who are agnates of the informant, allegedly committed assault upon the informant. Specific allegation of commission of assault and causing injury at the head of the informant is against petitioner no.2- Preetam Kumar @ Preetam Kumar Since the petitioner no.2- Preetam Kumar @ Preetam Kumar has caused injury at the head of the informant with lathi, I

Patna High Court Cr.Misc. No.3060 of 2017 (2) dt.17-02-2017 2/2 am not inclined to enlarge him on anticipatory bail. The prayer for anticipatory bail of petitioner No.2- Preetam Kumar @ Preetam in connection with Chautahm P.S. Case No. 155 of 2016 is rejected. Since there is general and omnibus allegations against other petitioners, let the petitioner Nos.1, 3 and 4, namely, Indradeo Mandal, Jyotish Kumar and Amit Kumar, respectively, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IInd, Khagaria /Successor Court in connection with Chautham Police Station Case No155 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
