This application has been filed for modification in the order dated 02.09.2016 passed in Criminal Misc. No.35146 of 2016 by this Court with regard to extend the period of surrender of the petitioners in the court below.

Learned counsel for the petitioners submits that vide order dated 02.09.2016 passed in Criminal Misc. No.35146 of 2016 by this Court, the petitioners were directed to be released on bail, in the event of their arrest or surrender before the learned court below within a period of four weeks from that date, on furnishing bail bond of Rs.10,000/-(ten thousand) each with two

No.13741 of 2017 (3) dt.12-04-2017 2/2 sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Madhubani, in connection with Khajouli P.S. Case No.53 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. but as the petitioners met with an accident, they could not surrender in the court below within the above stated period and prays for modification in the order dated 02.09.2016 passed in Criminal Misc. No.35146 of 2016 by this Court with regard to extend the period of surrender of the petitioners in the court below in connection with the aforesaid case.

In that view of the matter, the period of surrender of the petitioners in connection with the aforesaid case in the court below is further extended for a period of four weeks from today. The order dated 02.09.2016 passed in Criminal Misc. No.35146 of 2016 by this Court is modified to the above extent only.

This application is, accordingly, allowed.
