The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 824 of 2019 registered under Sections 272, 273 and 290 of the Indian Penal Code and Sections 30(A), 34, 36, 38 and 41 of the Bihar Excise Act, 2016. The accusation is on receiving secret information about preparing the illicit liquor by Sanjeet Kumar and Anil Das (petitioner), the informant and other police personnel reached at village Muhammadpur. On seeing the police party, one person started to flee away but on chased he was apprehended, who disclosed his name as Sanjeet Kumar. On search, six litres country made liquor, 90 litres of semi prepared liquor and

Patna High Court CR. MISC. No.54337 of 2019(2) dt.29-08-2019 2/2 utensils for using preparation of liquor were found from the hut of Sanjeet Kumar and Anil Das (petitioner).

Learned counsel for the petitioner submits that the hut, from where, the aforesaid liquors and utensils were recovered are not belonging to the petitioner and this petitioner has falsely been implicated in this case mere on suspicion and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 824 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
