The petitioner has preferred this application for grant of regular bail in a case registered under sections 379 and 34 of the Indian Penal Code to which section 411 of the Indian Penal Code was added subsequently.

As per the prosecution case, the motorcycle of the informant which he had parked was stolen. From the CCTV footage it transpired that three accused persons including the petitioner herein were involved in stealing the same. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 9 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Bettiah (Town) (Kalibag O.P.) P.S. Case no. 442 of 2021 (G.R. No.3997 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran.
