The petitioner is apprehending his arrest in a case instituted u/s 147, 148, 149, 341, 323, 504, 307 and 379 of the Indian Penal Code.
The prosecution case, in brief, is that on 16.2.2015 at 5.30 a.m. the informant was coming from natural call and as soon as he reached on road in front of Baharghara of Rajdeo Singh,Govind Singh, Awadhesh Singh, Rajdeo Singh, Shashi Kumar, Deokali and four other persons sitting there, seeing the informant told to kill him and all the accused persons restrained him and Govind Singh assaulted on his chest by butt of the gun,
Patna High Court Cr.Misc. No.21749 of 2015 (3) dt.13-07-2015 2/2 Awadhesh Singh also assaulted by butt of the gun. Other accused persons also assaulted by lathi and Govind Singh made fire and taken golden chain and other accused persons taken mobile and Rs. 5,000/-.
On behalf of the petitioner, it has been submitted that it a case and counter case. Counter case is Annexure 2 to the present application. It is further submitted that as per allegation the butt of the gun was used for the purpose of assault. On behalf of the State and the informant it is submitted that the petitioner is named in the FIR. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, District- Aurangabad, in connection with Daudnagar P.S.Case No. 40/2015 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
