Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307, 354, 379 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, these petitioners assaulted by means of iron rods and sticks as a result of which both of the injured sustained grievous injuries. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is further submitted that present case is counter blast of Balrampur PS case No. 74/2021 and to save his skin from

Patna High Court CR. MISC. No.67638 of 2021(3) dt.29-08-2022 2/2 that this false case has been filed.

Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail and submits that there is direct and specific allegation against these petitioners that they assaulted two persons who sustained grievous injuries.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
