JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 25.02.2015 in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Admittedly, the dead body of the deceased was found on the railway track and the informant stated in his ferdbeyan that one Jogi Rai was behind the alleged occurrence and so far as petitioner is concerned, he is said to be conspirator but submission on behalf of the petitioner is that the nephew of Jogi Rai was killed for which a case was lodged against the informant as well as petitioner of this case and some others.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.19960 of 2015 (2) dt.21-05-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 355 of 2014.
