JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No. 48 of 2018 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. The present case was registered against unknown person after recovery of an unknown dead body. However, in course of investigation, three co-accused were arrested and confessed their guilt disclosing the involvement of the petitioner.

Learned counsel appearing for the petitioner submits that co-accused Jibendra Kumar Singh @ Azad Singh, with

Patna High Court Cr.Misc. No.59611 of 2018(3) dt.14-12-2018 2/2 whose wife the deceased had sweet relation, has already been admitted to anticipatory bail by a co-ordinate Bench of this court vide order dated 29.08.2018 passed in Cr. Misc. No. 47241 of 2018. It is further submitted that except the so-called confessional statement of co-accused, there is nothing against the petitioner.

The submission of learned counsel of the petitioner appears to be correct from perusal of entire case diary. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Darbhanga in Bahadurpur P.S. Case No. 48 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
