JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Hasanpur Police Station Case No. 164 of 2013 registered for the offences punishable under Sections 420,467,468,406,323,342 and 302/34 of the Indian Penal Code.
Petitioner no. 1 is legally wedded wife of the informant, who solemnized her marriage with the petitioner no. 1 after death of his first wife. Admittedly, the first wife of the informant died in mysterious circumstances and a case under section 304B of the Indian Penal Code was lodged against the
Patna High Court Cr.Misc. No.14975 of 2014 (4) dt.24-03-2015 2/2 informant and his other family members.
Learned counsel appearing for the petitioners submits that the mother of the informant died in course of her treatment and moreover, the petitioner no. 1 has filed case under section 498A and other minor sections of the Indian Penal Code. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rosera, Samastipur in Hasanpur Police Station Case No. 164 of 2013, subject to condition as laid down under Section 438(2) of the Cr.P.C.
