JUSTICE BIRENDRA KUMAR ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419/420/467/468/471/472/409/120B of the Indian Penal Code. Allegation is that four students were admitted in the school, where the petitioner was a Principal, whose transfer certificates were found to be forged one on the basis whereof it was shown that those students were provided with dress allowance, school allowance and scholarship allowance.

Allegation is that just to misappropriate the public fund, fictitious admission on the basis of aforesaid certificates were shown by the accused persons in different cases.

Submission is that similarly situated co-accused

Patna High Court Cr.Misc. No.9436 of 2017 (2) dt.16-03-2017 2/2 Umashankar Ram, Siyaram and Rajendra Kumar @ Rajendra Yadav have already been allowed bail by different coordinate Benches of this Court.

Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura/Successor Court in connection with Murliganj Police Station Case No.180 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
