1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 126(2), 115(2), 118(2), 109(1), 351(3), 352 of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. The learned counsel appearing on behalf of the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on account of dispute on the playground, the accused persons came and 12 named accused persons assaulted the son and nephew of the informant

No.58900 of 2025(2) dt.10-09-2025 2/3 by lathi, danda and sword on order of Kishore, who fired also, further they also assaulted Indrajeet, who came to save them by sword causing injury on head, thereafter the accused also assaulted her elder brother-in-law Sanjay, further Shivnath, a villager was also assaulted and the injured were taken to hospital from where Sanjay was referred to PMCH, Patna.
4. Learned counsel submits that from perusal of allegation as alleged in the FIR, it would manifest that on account of dispute on the playground, the occurrence is alleged to have taken place. It is next submitted that both side assaulted each other. It is further submitted that no specific allegation of assault is alleged against the petitioners. It is reiterated and submitted that petitioners are persons with clean antecedent and are not criminals and they will not abscond rather will cooperate in the investigation to prove their innocence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-
Patna High Court CR. MISC. No.58900 of 2025(2) dt.10-09-2025 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Daraunda P.S. Case No. 189 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioners despite giving assurance to this court are not co-operating in the investigation in that event the learned trial court shall be at liberty to cancel the bail bonds of the petitioners.
